I don't think that using Mario assets is allowed in PB actually, but I think if you only export to .exe should not be a problem, as you're the responsible though, still I don't recommend it and I'm probably wrong. Anyways if you want some assets go to:
https://www.spriters-resource.com/snes/smassmb3/
These are assets of SMB3 All Stars, there are many more.

Also, looks like you have discord account, check my PB discord server if you want

Yeah, just don't use explore. And my PB Mario engine wouldn't use copyrighted Mario sprites. You have to provide those yourself. I'll provide the programming, but sprites are up to you.

Frankly, I'd like to see someone make a convincing and authentic Mario game with PB. With the newish ability to change character sprites to different sizes, it's starting to look like a real possibility.

It IS a possibility, TingThing! I've already copied quite a few things from Mario and put them into PB. We can edit physics and do all sorts of things. ASM was actually supposed to originally be a Mario-like game. It's not so much like that anymore, though.

Game companies can be sensitive about copyright and trademarks. I had a game on Steam called "Call of Booty". Activision did not like that one little bit and forced me to remove it.

It was a platformer about a letch who has a spell cast on him by an old wizard. The spell makes him irresistible to women. The objective was to not come into contact with any women for the duration of the game. The wizard would reward the character with $1M if he managed it.

I was very surprised by how successful my little game was. There were hundreds of reviews and a few on Youtube. Alas, Activision got wind and ruined it. I guess I deserved it for riding on their success.
